Australia - Pork producers consider legal action

Australia's leading pork producer's group will decide tomorrow what legal action it will take over pig meat imports. Australian Pork Limited (APL) has previously threatened to launch an injunction against the Department of Agriculture unless the Federal Government revoked import permits. The Government announced yesterday that that will not happen. Nigel Smith from Australian Pork says he is disappointed that the decision was not based on science. "We represent 2,500 pork producers in the country and they're all very right behind this case," Mr Smith said. "It would be negligent on our behalf if we didn't pursue this all the way. "They're wanting this to happen and they believe they've got a very good case and so do we." Meanwhile the director of quarantine has written to APL saying it will not revoking the 83 permits held by pigmeat importers, not party to the legal proceedings in the Federal Court. The board of APL threatened new court action if the director did not ban existing permits from PMWS-affected countries by 5.00pm yesterday. It came after the Federal Court banned the government from issuing any new permits to import pigmeat into Australia. But Department of Agriculture spokesman, David Finlayson, says the director of quarantine will act in accordance with the court's orders. "The director of Australian Quarantine has rejected the demands being made by APL and does not accept that the declaration made by the Federal Court had the affect being claimed by APL," Mr Finlayson said. "The director is required to treat those remaining permits as valid, unless an order of the court has established otherwise."
